What is the Macro-Enterprise Investor Visa?

The Macro-Business Investor Visa is a type of permanent residence permit that Panama offers to foreigners who make significant investments in large-scale business projects in the country. This type of visa is granted to those who contribute to economic development and generate employment on a large scale.

Investment and Other Requirements

To apply for the Permanent Residence Permit as a Macro-Company Investor, the applicant must meet the following requirements:

Minimum Investment

Requirements:

Make a minimum investment of $160,000 in the company’s equity.

  • Passport: Original and valid for at least six months, in addition to a copy authenticated by a Panamanian notary public.
  • Criminal Record Certificate: Issued by the country of origin or residence, duly apostilled.
  • Health Certificate: Issued by an authorized professional, within the three months prior to the application.
  • Photographs: Four passport-size photos.
  • Business License or Notice of Operation: A simple copy that proves that the company is legally incorporated.
  • Proof of Investment: Documents that support the minimum investment required.
  • It must include at least five Panamanian employees working full-time, minimum wage, and registered.

It must be in favor of the company.

  • It must include the receipt of payment, authenticated at the Ministry of Economy and Finance.

Application Process

The process of applying for a permanent residency visa as a Macro-Company Investor in Panama is rigorous and requires the careful preparation of the necessary documentation. At Legalia Panama we can help you with the entire process of obtaining your visa, saving you time and money.

General Requirements:

  1. Power of Attorney (notarized) and Request.
  2. Three (3) photographs.
  3. Authenticated copy of the passport.
  4. Criminal record certificate.
  5. Health certificate.
  6. Certified check for B/.250.00 (National Treasury).
  7. Certified check for B/.800.00 (National Immigration Service).
  8. Affidavit of personal background.
  9. Public Registry Certificate that accredits the corporate name, dignitaries, legal representative and capital stock (minimum B/.160,000.00).
  10. Certification from the secretary or treasurer of the company accrediting shares released and paid (minimum B/.160,000.00).
  11. Copy of the pages of the action book.
  12. Certification by the authorized public accountant on ownership of shares and activities of the company.
  13. Applicant’s statement on invested capital and company activity.
  14. Receipt of capital gains tax and share purchase agreement (if applicable).
  15. Declaration of income of the company and peace and corresponding salvo.
  16. For new companies: proof of payment of a single fee and registration in the RUC.
  17. Payroll authenticated by CSS with at least five Panamanian employees per applicant.
  18. Paz y salvo in force of the CSS.

Proof of investment (evidenced by three of the following documents):

  • Bank certification of transfer of funds from abroad (mandatory).
  • Proof of capital gains tax (if applicable).
  • Authenticated deposit in favor of the company.
  • Contract of sale of the premises.
  • Audited financial statements.
  • Bank document certifying the foreign origin of the funds.
  • Commercial invoices with inventory detailed by CPA.
  • Customs settlements in the name of the company.
  • Other documents that prove the investment.

Proof of existence and location of the company (minimum three):

  • Lease agreement for the commercial premises.
  • Utility billing.
  • Proof of ITBMS.
  • Proof of municipal taxes.

Permit for Dependents:


    • Letter of responsibility.
    • Proof of kinship.
    • Proof of address.
    • Additional certificates for those over 18 years of age (singleness and studies).

PERMANENT PERMANENCE
To apply for permanent residence, the above requirements must be presented, except for the criminal record certificate and checks. In addition, the following must be provided:

  1. Peace and national security of the company’s income.
  2. Copy of the income tax return with registered payment of shares (minimum B/.160,000.00).
  3. Form 03 submitted to the Ministry of Economy and Finance.
  4. Paz y salvo in force of the company’s SSC.

Additional Requirements for Dependents

      • Increase in Investment: The investment must be increased to an additional $2,000 for each dependent.
      • Marriage and Birth Certificates: For children under 25 years of age, duly apostilled or authenticated.
      • Letter of Responsibility: For dependents, provided by the lawyer or entity advising on the process.
  • Gather Documentation: Complete all forms and gather the necessary documents.
  • Apply: The application must be submitted by a lawyer at the National Directorate of Migration.
  • Review and Approval: The Migration Directorate will review the application and issue an approval if all requirements are met.
  • Obtaining the Permit: Once approved, the permanent residence permit and identity card are issued.

Legal Basis

The Political Constitution of the Republic of Panama is the supreme document that establishes the fundamental principles and norms of the State, guaranteeing rights and freedoms, and organizing the functioning of the government and its institutions.

Decree-Law No. 3 of 22 February 2008 regulates Panama’s migration policy, establishing rules and procedures for the entry, stay and residence of foreigners in the country.

Executive Decree No. 320 of August 8, 2008 establishes specific procedures and requirements for obtaining different categories of visas and residence permits in Panama, facilitating migration regulation.

Executive Decree No. 26 of March 2, 2009 introduces modifications and additional provisions to Executive Decree No. 320 of August 8, 2008, updating the procedures and requirements for various categories of visas and residence permits in Panama, in order to make the immigration process clearer and more efficient. Law 38 of 2000, for its part, regulates public administration in Panama, establishing rules on transparency, access to information and the functioning of government institutions, which contributes to an orderly and accessible immigration system.
